These Terms and Conditions govern your use of Cognitive Living website and AI home assistant services. By accessing or using our services, you agree to be bound by these terms.

1. Definitions

"Service" refers to the AI home assistant solutions provided by Cognitive Living, including Elderly Care AI Companion, Energy Optimization Intelligence, and Security AI Monitoring systems.

"User" means any person accessing our website or utilizing our AI home assistant services.

"Content" includes all text, images, software, data, and materials available through our services.

"We/Us/Our" refers to Cognitive Living, registered in Zürich, Switzerland.

"Agreement" means these Terms and Conditions along with our Privacy Policy and Cookie Policy.

2. Use of Services

Our AI home assistant services are provided for personal residential use within Switzerland. By using our services, you agree to:

  • Be at least 18 years old or have parental/guardian consent
  • Provide accurate and current information during registration and service setup
  • Maintain the confidentiality of your account credentials and system access
  • Use the services in accordance with all applicable Swiss laws and regulations
  • Not interfere with or disrupt the integrity or performance of our services
  • Allow authorized technicians access to your premises for installation and maintenance
  • Follow all safety guidelines and operational instructions provided

3. Prohibited Uses

Users are expressly prohibited from:

  • Violating any applicable local, national, or international laws or regulations
  • Infringing on intellectual property rights of Cognitive Living or third parties
  • Transmitting harmful code, viruses, or malicious software through our systems
  • Attempting unauthorized access to our servers, networks, or other users' accounts
  • Engaging in fraudulent activities or misrepresenting your identity
  • Reverse engineering, decompiling, or disassembling our AI software and systems
  • Using our services for illegal surveillance or privacy violations
  • Reselling or redistributing our services without written authorization
  • Tampering with hardware or modifying system configurations without approval

4. Intellectual Property Rights

All intellectual property rights in our services, including software, algorithms, designs, content, and trademarks, remain the exclusive property of Cognitive Living. We grant you a limited, non-exclusive, non-transferable license to:

  • Use our AI home assistant services for personal residential purposes
  • Access the web interface and mobile applications for system management
  • Receive software updates and technical support as part of your service agreement

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any part of our services without prior written permission. User-generated data collected by our systems remains your property, subject to our Privacy Policy.

5. Service Delivery and Installation

Our AI home assistant services require professional installation by certified technicians. Service delivery terms include:

  • Installation scheduling within 2-4 weeks of order confirmation, subject to availability
  • On-site assessment to ensure compatibility with your home infrastructure
  • Hardware setup, software configuration, and initial system training
  • User orientation session covering operation, safety protocols, and maintenance
  • 90-day initial support period included with all installations

Installation times vary based on service complexity: Elderly Care AI typically requires 4-6 hours, Energy Optimization 6-8 hours, and Security AI Monitoring 3-5 hours. Additional time may be needed for custom configurations or integration with existing smart home systems.

6. Payment and Billing

Payment terms for Cognitive Living services:

  • One-time setup fees are due upon order confirmation via bank transfer or credit card
  • Optional maintenance plans are billed monthly in advance starting 90 days after installation
  • All prices are listed in Swiss Francs (CHF) and include Swiss VAT where applicable
  • Payment must be received before installation scheduling
  • Late payments on maintenance plans may result in service suspension after 30 days
  • We accept major credit cards, bank transfers, and TWINT payments

Refund policy: Full refund available if cancelled within 14 days of order and before installation. After installation, refunds are prorated based on service usage, minus a CHF 500 processing fee. Hardware remains property of Cognitive Living and must be returned in working condition.

7. Disclaimers and Limitations of Liability

While we strive to provide reliable AI home assistant services, certain limitations apply:

  • Services are provided "as is" without warranties of any kind, express or implied
  • We do not guarantee specific results, performance metrics, or energy savings outcomes
  • AI predictions and recommendations are probabilistic and may not be 100% accurate
  • System availability depends on internet connectivity and power supply
  • We are not liable for decisions made based on AI recommendations
  • Maximum liability limited to the total fees paid for services in the 12 months preceding the claim
  • We are not liable for indirect, consequential, or incidental damages

Our AI systems are designed to assist and enhance home living but should not replace professional medical advice, security services, or energy consultants. Users assume responsibility for final decisions regarding home management, elderly care, and security measures.

8. Data Collection and Privacy

Our AI home assistant services process various types of data to function effectively. Data handling includes:

  • Local processing on edge devices installed in your home for privacy protection
  • Encrypted transmission when cloud connectivity is required for updates or remote monitoring
  • Compliance with Swiss Federal Data Protection Act and GDPR requirements
  • No sale or sharing of personal data with third parties for marketing purposes
  • Right to request data access, correction, or deletion at any time
  • Retention of anonymized usage data for service improvement and AI training

9. Service Modifications and Updates

Cognitive Living reserves the right to modify, suspend, or discontinue any aspect of our services with appropriate notice:

  • Software updates and AI model improvements are deployed automatically with your consent
  • Major feature changes or service modifications will be communicated 30 days in advance
  • Emergency updates for security patches may be applied immediately
  • We may temporarily suspend services for scheduled maintenance with 48-hour notice
  • Service discontinuation requires 90-day notice with options for alternative solutions

Users with active maintenance plans will receive priority support during transitions. Hardware upgrades may be offered at discounted rates when older systems reach end-of-life.

10. Termination

Either party may terminate the service agreement under the following conditions:

  • User termination: 30-day written notice required, with hardware removal scheduled within 60 days
  • Immediate termination by Cognitive Living for violations of these Terms
  • Termination for non-payment after 60 days of overdue maintenance fees
  • Upon termination, user data is retained for 90 days then permanently deleted
  • Prorated refunds for prepaid maintenance periods exceeding 90 days
  • Hardware must be returned in working condition or replacement fees apply

Certain provisions survive termination, including intellectual property rights, liability limitations, and dispute resolution clauses. Final account settlement occurs within 30 days of termination.

11. Dispute Resolution

In the event of disputes arising from these Terms or our services, the following resolution process applies:

  • Initial attempt at informal resolution through direct communication with our customer service team
  • Mediation as a second step, with costs shared equally between parties
  • Binding arbitration in Zürich, Switzerland under Swiss Arbitration Rules if mediation fails
  • Arbitration conducted in English or German at the claimant's choice
  • Small claims (under CHF 5,000) may be filed in local courts

Governing Law: These Terms are governed by Swiss law. Exclusive jurisdiction lies with the courts of Zürich, Switzerland for any disputes not resolved through arbitration.

12. Modifications to Terms

Cognitive Living may update these Terms and Conditions periodically to reflect changes in our services, legal requirements, or business practices:

  • Material changes will be communicated via email 30 days before taking effect
  • Notification banner on our website will announce updates to these Terms
  • Continued use of services after changes constitutes acceptance of new Terms
  • Users who disagree with modifications may terminate services within 30 days without penalty
  • Version history and change logs are maintained for transparency

13. General Provisions

Entire Agreement: These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cognitive Living regarding our services.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

No Waiver: Failure to enforce any right or provision does not constitute a waiver of that right.

Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to any affiliate or successor entity.

Force Majeure: Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, power outages, or government actions.
